THE IMPLEMENTATION OF THE LEGAL CERTAINTY PRINCIPLE IN DETERMINING THE ABILITY TO MAKE NOTARIAL DEEDS BEFORE A NOTARY

This study aims to find out the legal basis for ability make an agreement before a notary and examine application of principle certainty in determining notarial deed. uses normative research method with statutory approach conceptual approach. The findings indicate that making is stated Article 39 paragraph (1) Notary Position Law (UUJN) deed, namely refers UUJN not Civil Code. resolution conflict norms by using preference, rules apply are UUJN, while Code do apply.
